Cursed Items and Blackout

My character bestowed a Mindnumbing Curse to an amulet and provided it to somebody else to wear. Through the course of rp that person with the mindnumbing curse was blacked out and it left a loot bag on the ground with the amulet. The amulet could not be picked up stating in the combat log "This item cannot be given away", as if it was still a cursed item that was attempted to be removed from its owner.

The real owner though says he still had the necklace equipped, however it was not providing the curse as it was supposed to. So it appears if somebody is wearing a cursed item and is blacked out the item is getting put to the ground and the person it is supposed to be bound to is getting an uncursed (?) copy.

DM Caster fixed it up. Would have to ask him if he just cast bestow curse on the copy or fixed it another way.
