An open letter to the Spellguard, posted at the Rock Bottom

Complaint against: Spellguard Agent Rey

Circumstances: Falsely arrested, fined and imprisoned by the agent. After paying a fine, I remained languishing in jail, despite the fact that payment of a fine should result in immediate release.

Summary of complaints: 1. Rey ordered "you" to stop - an unclear order in the crowded area outside the entrance of the Rock Bottom inn. Who he meant by "you" could have been anyone in the vicinity. Clarity in making orders is a necessity, and failure to obey orders lacking clarity

2. Rey failed to announce himself as a Spellguard agent, at any point in the arrest. As I understand it, he is required to announce his authority.

3. Rey claims that a weapon was drawn on him at the gates, but preparing one's weapon is a normal precaution when leaving the city gates. His claim of "drawing a weapon" on him is completely false and unwarranted. What madman would seek to provoke a fight in front of a dozen guards? Surely he can't have felt threatened?

4. Failure to release on payment of the fine. As I understand it, payment of a fine is in lieu of jail time - not in addition. Additionally, he threatened to take the fine by force if not handed over. I believe this is also against standard protocol.

5. Failure to state the exact charges. As I understand it, arresting an individual requires explaining to them the nature of the charges and the reason for them. Rey failed to indicate what the charges were exactly.

6. Requested a councillor to refute the charges. Having just left the inn where Coincillor Masini was socializing, one was clearly available. Rey failed to attempt to procure a councillor to judge the fairness of the charges, not even making the effort of making a sending the councillor have left the inn.

7. While jailed, I was assualted by a dwarf also extorted of his coin on presumably false charges. While his anger is understandable, Rey failed to move either him or myself to separate cells. Safety of the prisoners, as I understand it, is his responsibility.

As a result, I would like the 300 coin fine returned, as jail time was served. Also, I request an additional 300 coins for compensation for false arrest and endangerment while jailed. Finally, I suggest Rey be formally reprimanded and required to serve under an experienced guard to learn the procedures for arresting individuals.

You should really try to avoid posting these sorts of things publically, as you only embarrass yourself. Point by point, as far as I can tell, your charges lack substantive merit and demonstrate a simple lack of understanding of Sanctuary law.

1. Agents routinely use pronouns when addressing suspects. This is acceptable behavior. Addressing suspects by name is not possible under most circumstances.

2. Uniformed law enforcers are not required to announce their authority. Where did you hear that they were?

3. If you drew your weapon while confronting Agent de la Rey, then you drew your weapon while confronting him. Whether or not it was in front of a dozen guards, or whether you were near the gates at the time that you did it, is irrelevent. Whether or not you are a madman is irrelevent.

4. Paying a fine doesn't necessarily take the place of imprisonment. For example, for sustained unauthorized magic use, the lawbook reads "Imprisonment + fine." Public nuissance reads "imprisonment and/or fine." Neither exclude the possibility of both. I honestly don't know how it could be made clearer.

Taking a fine by force is not only acceptable, but is usually necessary when criminals refuse to cooperate. Simple refusal to pay a fine is certainly not legitimate grounds to be excused from it. Who told you that it was?

5. Again, where did you get this impression? Citizens may only be arrested with due cause and they must be charged with a crime, but there is no requirement that the arresting officer state and explain the exact charges during the course of the arrest.

6. Councilors supervise cases requiring Council's Judgement. Processing criminals would be impossible if every petty offender could demand a Councilor to review their case.

7. Safety of prisoners is the Watch's responsibility, if anybody's, and it is accepted that space within the Watch House is limited due to the amount of funding diverted to pay for the presence of the Tigereye Mercenary Company in the city, and thus it is not unusual that under certain circumstances more than one criminal will be put in a cell.

I recommend that you speak with an individual who has experience with Sanctuary's law enforcement procedures before levying these sort of charges, particularly in such a public fashion.
