BioWare should have this bug fixed in patch 1.69.

Can't there be a brief work-around? Perhaps freedom of movement for sharks?
actually, this could be entirely solved if Wildshape were to behave more like the Shifter script. It would, incidentally, also make Wildshape feel much less... clunky.

freedom of movement does not last long, while a druid can effectively stay in shark form until they are bored with it
also, it completely precludes any druid from using any form underwater... unless they really feel like moving slow and possibly drowning. remember we can shift long before we can cast freedom of movement and shark form isnt the only viable form underwater

The nature of the 'bug' is when the character 'reshifts' all bonusess are re-applied to the character, item weights recalculated. The script is probably thinking they are wearing armor (which they probably aareif they unshift), and therefor applying the movement speed penalty. There isnt really a buff that can stop this. If freedom of movement did suddenly allow unrestricted underwater movement, I'd consider it more of a bug than this.
As it is now, I beleive there -may- be a way to fix it, it's just up to the DMs to see if it is desireable.

underwater areas are ... quite expansive
this simply is not a solution. Worse, it doesn't even touch on the fact that a young druid may want to use a wildshape underwater... for the spell like abilities that do not have guaranteed failure, only to find out that they are now near immobile (think magical slow + heavily encumbered + stealth + search speed). And this near immobile state remains until the druid leaves the water. shifting back to human form does not fix it.

indeed there is a fix. and yes it is up to the dms to decide if they want to spend the time to do it. also, freedom of movement does indeed correct the problem, allowing you to move at full speed underwater, it just doesnt last very long and is only available to level 7+ druids.
So it comes down to... replacing wildshape with a limited Shifter script, or waiting till 1.69 comes out... which could be a while still.

This was not fixed by 1.69.
Seems like slapping Freedom of Movement on sharks would be a very easy way to fix this I don't see why it's not done!
The shifter and, as far as I know, werecreature systems are not plagued by this.
Rather than granting druids Freedom of Movement while underwater, it seems to me that it might be more balancing to simply take these shifting systems and strip them down to basics for general druid use.
At the least, it should be possible to add a check on the system-if you're polymorphed shark-the system can check if you have a movement decrease and remove it. That would be wonderful; as it is, sure druids can't drown but they can't actually move since the speed decrease is so terrible. I can try to move down a hall and have time to go get a soda before I get there.
