This somewhat-common loot item is usable by pretty much everyone. I don't understand why this is not limited by alignment, and suggest that it should be!

I would also suggest non-cyric god users get spell failure since it's clearly a cyric emblem on the cloak and why would your deity allow you to have another deity's symbol on you?

This is a good idea. Divine classes should get a penalty for using an item of another idea. This isn`t the only item this rule could apply to, but I understand if it might be too time-consuming to script in.
Most of the other ones are amulets, I think.

Given Cyric's dogma, and the fact he sees all other gods, and their priest(esse)s as 'false prophets', and all around 'infidels'. I doubt he'd be much up for non-Cyric followers wearing his most holy symbol.
But. who knows? Maybe it's his master plan. Get folks wearing the trendy cloaks with the neat skulls on them..next step, full conversion.

I guess the issue is merely how you look at it. Do you look at it from the god's perspective, the player's perspective, or the character's perspective? Or..the one that trumps them all. The DMs perspective. Hehe.
The item has Cyric's symbol on it from Bioware standard art, so any PC can see you toting around Cyric gear. I would still be very surprised if anyone wore such a cloak around any length of time without getting at least threatened by another player.
But yeah, I suppose in a sense it's entirely possible that you could gain divine spell failure for wearing such an item, as the item was originally made by Cyric's power. Therefore, doning such an item is, in a sense, admitting to Cyric's might even if the intent is entirely based off of convience.
Of course, given that there are quite a few god themed items to be found and relatively few alignment or god neutral useful items by comparison, it would probably be best to get some kinda DM ruling on this.

I think you're probably approaching closer to what the intent might have been with your second idea. Cyric is probably unaware of the fate of every item he's produced, much less the natures and intents of most who use them.

Actually, as per Faiths & Pantheons, I'm pretty sure he's aware of anything that currently has his symbol on it. Anywhere. Also whenever does anything relating to his portfolio. But it's been a while, and I don't have my copy onhand right now.
