I'll address the concerns as they have been raised. In the first instance, the assertion is simply false. The decree in no way classifies engaging illithid in battle as a capital offence.
In the second instance, your argument is fallacious. The purpose of a justice system is to punish those who would break the law. We do not exempt men merely because they hold those laws in disdain.
If the Society has well founded concerns regarding the proposed measures, I'd hear them out.
